  • Henke prosecuted important pretrial appeal from a trial court decision applying "tort reform" legislation to deny his client's rights to pursue punitive damages. Henke obtained a stay of the trial, persuaded the appellate court to intervene on an "extraordinary writ," overturn the trial court's decision and change the law, essentially removing the teeth from the tort reform law. James Looney v. Superior Court, 16 Cal.App.4th 521 (1993)[reh. den. July 10, 1993][rev. den. September 2, 1993]

  • On behalf of a single client Henke filed another "petition for writ of mandamus" from an Ohio Federal District Court's certification of a "mandatory class action" and Court approved $120,000,000 brokered settlement purporting to bind 1000 product liability claimants in Ohio and all others nationwide. Mr. Henke argued on appeal to the United States Court of Appeals for the Sixth Circuit that the District Court's class certification and settlement impaired his single client's right to choice of the attorney of his preference and control over his individual litigation. The United States Court of Appeals agreed with Mr. Henke's position, overturned the Federal District Court's order certifying the class, and voided the $120,000,000 settlement.
